These Terms describe how MyCompanyDesk supports your invoicing, expense and VAT workflows, while responsibility for every user of your account remains clear.
Our goal is to provide a dependable platform for invoicing, expenses, VAT and the day-to-day administration of your business.
Clear processes and clear ownership of data. You always know how your data is handled.
Roles and permissions decide who can do what in your books.
We carry out planned maintenance and monitor the service. We do not guarantee any specific availability percentage.
You are responsible for all activity that takes place under your account, including the actions of anyone you authorise.
To use the service, you must be at least 18 years old.
You are responsible for maintaining the confidentiality of your account.
You agree to provide accurate business information and to keep it up to date.
Keep the platform safe for everyone.
No unlawful, fraudulent or abusive activity is permitted.
No attempts to access or disrupt other accounts or systems.
No uploading of malicious code or content.
You retain ownership of the business data you enter into MyCompanyDesk. We use that data solely to provide and improve the service.
MyCompanyDesk and its content, trademarks and software are owned by MyCompanyDesk. You are granted a limited, non-exclusive licence.
We strive to keep the service available, but may modify, suspend or discontinue features where possible with reasonable notice.
We provide customer support via email or scheduled calls. Response times may vary during periods of high volume.
Our liability is limited. The full arrangement, including the maximum amount, is set out in the Liability and governing law chapter further down this page. That arrangement applies; no separate or broader limitation is stated here.
You agree to indemnify and hold MyCompanyDesk harmless from claims arising out of misuse or breach of these Terms.
We may suspend or terminate accounts that violate these Terms. You may stop using the service at any time.
MyCompanyDesk is an invoicing and business administration tool, not a registered tax adviser or accountant. The software provides calculation tools and reporting features, but these do not constitute professional tax, legal or accounting advice. Always consult a qualified tax adviser or accountant for decisions about VAT obligations, tax returns and financial compliance.
You are solely responsible for the accuracy of your invoices, VAT calculations, tax returns and compliance with the applicable legislation in your jurisdiction. This includes correctly applying VAT rates, reverse-charge schemes and intra-Community supply rules. MyCompanyDesk provides tools to support you, but the legal responsibility for accuracy lies with you and/or your accountant.
MyCompanyDesk is not liable for losses, fines, penalties or damages resulting from incorrect VAT calculations, missed returns, invalid VAT numbers or other tax-related errors. Although we strive for accuracy, automated calculations should always be verified by a qualified professional before they are submitted to the tax authorities.
Under Dutch tax law (Article 52 of the General State Taxes Act), financial records, including invoices, expenses and VAT data, must be retained for 7 years. This statutory obligation takes precedence over deletion requests for the relevant data during the retention period.
In accordance with the EU Consumer Rights Directive (2011/83/EU) and Dutch law (Civil Code 6:230o), consumers have a 14-day cooling-off period from the date of purchase. This right may not apply if, with your express consent, you have begun using the digital service during the withdrawal period.
If you have a complaint about our service, contact us at [email protected]. We aim to respond within 14 working days. If your complaint is not resolved to your satisfaction, you can refer the dispute to the European ODR platform via ec.europa.eu/consumers/odr.
We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Dutch UAVG. Full details of how we process your data are in our Privacy Policy.
You can cancel a monthly subscription at any time, effective from the next billing period, via your MCD account. An annual subscription runs for the term you have chosen and, after the first year, can be cancelled on a monthly basis, free of charge and without automatically renewing for another full year. For consumers, this right follows from the Van Dam Act (Civil Code 6:236 sub j); for business customers, we voluntarily apply the same arrangement.
We announce price changes at least 30 days in advance by email to the address held in your account. Until the effective date, you can cancel the subscription free of charge, effective from the next billing period, if you do not agree with the new price.
A monthly subscription renews automatically on a monthly basis for as long as you do not cancel. After the first year, an annual subscription renews on a monthly basis only, not for another full year, and you can cancel it at any time.
New workspaces get the Office plan for 60 days at no cost. You do not need to provide payment details and nothing is charged. No subscription arises unless you choose one yourself. If the trial ends without you taking a paid plan, your workspace moves automatically to Desk, free. Your data is kept and you can keep invoicing; the Office features lapse. We email you before the trial ends.
These terms apply to bookkeepers and accountants taking part in the partner programme.
As an active partner you get an Office plan for yourself at no cost. Active means you refer at least one client per quarter. If you refer no client for a quarter, the free Office plan may be ended; we give at least 30 days' notice.
A client who signs up with your partner code gets the Office plan free for 12 months, counted from the day the workspace is created. After that the client chooses: Office or the free Desk plan. The client is never locked in.
We may change or close the partner programme to new sign-ups. Commitments already running are honoured: a partner who already has free Office and stays active keeps it, and a client who has already been granted 12 months of free Office serves out that period. There is no commission, no contract and no minimum number of clients.
In the past, individual agreements were made with a limited number of users about their subscription. MyCompanyDesk honours those agreements. They apply for the lifetime of MyCompanyDesk: as long as the service, and the component concerned, is offered. New users can no longer sign up for these.
Users who signed up at the time under the promotional terms then in force keep their first year of Office free and, after that, a permanent 50% discount on the Office subscription, including on future price increases. Users from the first group who signed up under those terms keep Office free for the lifetime of MyCompanyDesk. The agreement is recorded per workspace.
Users who were identified as entitled during the move to the current subscription structure keep free access to the Office subscription (into which the earlier Business and Pro subscriptions were merged) for the lifetime of MyCompanyDesk. This agreement is recorded per workspace and does not lapse on price changes or new subscription types.
"Forever" and "lifetime" mean for the lifetime of MyCompanyDesk. The agreements end automatically when MyCompanyDesk is discontinued as a service, or when a component of it, such as an included domain, is no longer offered. In those cases no right to a refund, continuation or transfer to another party arises. MCD is under no obligation to continue an agreement beyond the existence of the service.
MyCompanyDesk's liability for direct damages is limited per calendar year to the amount the customer paid to MCD in the twelve months preceding the event causing the damage, up to a maximum of EUR 5,000. MCD is not liable for indirect damages such as lost profits, missed savings or reputational harm. This limitation does not apply in the event of intent or wilful recklessness.
These Terms are governed by Dutch law. Disputes will be submitted exclusively to the competent court in the Midden-Nederland district, unless mandatory consumer law designates a different court.
MyCompanyDesk offers delivery tracking features for invoices, so that users can confirm that their invoices and communications reach their clients.
Emails and PDF invoices sent via MyCompanyDesk may contain small transparent tracking images (pixels). When these are loaded, they record that the email or document has been opened. The client portal also records interactions such as viewing, downloading and payment confirmation actions.
Tracking events record a privacy-preserving hash of the IP address (not the full IP), the date and time, and basic information about the browser or reader. This data is available only to the MyCompanyDesk user who sent the invoice. Full details are set out in our Privacy Policy.
